We, Olydream Labs Pvt Ltd, (“Olydreams”, “Company”, “we”, “us”, “our”) are the owners of the game namely Pro Shooter VR (the “App”) and website www.proshootervr.com (the “Website”). The website provides information about the App. The App facilitates the users to play our virtual reality gun shooting game. The App and Website are collectively referred to as “Platform”. The App is available to the users on Oculus (a gaming platform owned by Meta Platforms Inc.).

We respect data privacy rights and are committed to protecting the personal information collected on this Platform. This privacy policy (“Privacy Policy”) sets forth how we collect, access, use and protect the personal information collected and accessed through the Platform.

BY CONTINUING TO USE THE PLATFORM, PROVIDING US PERSONAL INFORMATION, YOU CONSENT TO OUR USE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THE TERMS OF THIS PRIVACY POLICY. IF YOU ARE ACCESSING THE PLATFORM ON BEHALF OF A THIRD PARTY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH THIRD-PARTY TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND, IN SUCH AN EVENT YOUR USE OF THE PLATFORM SHALL REFER TO USE BY SUCH THIRD PARTY. THIS PRIVACY POLICY IS GOVERNED BY AND IS COMPLIANT WITH THE INFORMATION TECHNOLOGY (REASONABLE SECURITY PRACTICES AND PROCEDURES AND SENSITIVE PERSONAL DATA OR INFORMATION) RULES 2011, WHICH IS DESIGNED TO PROTECT THE PERSONAL INFORMATION; AND OTHER APPLICABLE RULES AND REGULATIONS RELATED TO PRIVACY.

For the sake of brevity, information including but not limited to the first name, last name, age, phone numbers, e-mail address, address, location, country/region provided to as part of the usage of the Platform shall be referred to as “Personal Information”.

Registration: When you register and create an account on Oculus and use our App, we may get access to your Personal Information including but not limited to your full name, email address, your date of birth, age, gender, phone number, country, platform username, user ID, list of friends, and followers. We may collect your Personal Information including username, user ID and profile photo.
  2. User’s device configuration details: We may get access to and collect your device configuration details such as the device’s unique identifier, IP address, operating system, and connectivity metrics.
  3. Gaming Data: When you create a gaming profile on Oculus, we may access to your gaming information such as your unique player ID, profile picture, avatar description, gaming modes, performance in the game, player rankings, game progress and preferred game settings (collectively referred to as “Gaming Data”).
  4. Country and IP address: When using the App, we may get access to details of your country and IP address.
  5. Payment information: You may have an option to make in-app purchases on Oculus. You will be required to provide certain payment information directly to Oculus and its payment processing partners, including but not limited to your name, credit/debit card/bank information. We do not access, store or collect your credit/debit card information or payment related sensitive data.
  6. Communications: We may collect your Personal Information from you when you send us emails, messages on our discord channel or social media pages, any communication for support or communications of any other kind.
  7. Blogs/newsletters: We may collect information such as email address from you if you subscribe to our blogs and newsletters on our Platform.
  8. Social media apps and accounts: We may also collect, store and use your Personal Information when you:
    1. access our social networking handles operated by us on Facebook, YouTube, Instagram, Reddit, Discord, Twitch, Twitter, and/or LinkedIn;
    2. share our blogs through Facebook, YouTube, Instagram, Discord, Twitch, Twitter, Reddit and/or LinkedIn; and
  • comment/ provide feedback/testimonials on such social networking handles.

Please make sure that any Personal Information you share with us is accurate and up to date information. If you are sharing any Personal Information on behalf of a third person, you should ensure that you are authorized.

  12. to display leaderboards, player rankings and scores on our Platform.
  13. for internal record keeping and to comply with our legal or statutory obligations.
  14. WHO DO WE DISCLOSE YOUR DATA TO?

We do not sell, rent, share, distribute, lease or otherwise provide your Personal Information to third parties, without your prior consent. Keeping this in mind, we may disclose your Personal Information in the following cases:

  1. Affiliates:We may provide your Personal Information to our affiliates to enable them to improve the Platform, provide feedback and respond to their queries.
  2. Service Providers:We may share your Personal Information with the service providers who work with us in connection with operating the Platform. All such service providers are subject to stringent confidentiality restrictions consistent with this Privacy Policy.
  3. Public Forums: We may share your information such as match history, player rankings, player scores, username on our leader boards posted on our Website, social media platforms or other similar public forums in order to help you engage with other players.
  4. With other players: We may share your information such as your username, match history, and scores with other players to support the multiplayer activities within our game, to add friends, invite people to play a game and to accept game challenge invites from other players.
  5. Merger or Acquisition:We may transfer your Personal Information if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the Platform, to a third party. Any such third party or resultant entity that receives your Personal Information shall have the right to continue to use your Personal Information in line with the purposes set out herein. In the event of such a sale or transfer, we may notify you.
  6. Legal and Regulatory Authorities:We may disclose your Personal Information in order to comply with our legal obligations/ court orders/ requests by Govt. authorities.
  7. Sub processing: If we outsource the processing of your Personal Information to third parties or provide your Personal Information to third party service providers, we will oblige those third parties to protect your Personal Information with appropriate security measures and prohibit them from using your Personal Information for their own purposes or from disclosing your Personal Information to others.
  8. HOW LONG WE RETAIN YOUR DATA?

We endeavor to only collect such Personal Information that is necessary for the purposes indicated here, and to retain such data for no longer than is necessary for such purposes. The length of time Personal Information is retained, and criteria for determining that time, are dependent on the nature of the Personal Information and the purpose for which it was provided/ collected.

  1. OUR SECURITY MEASURES

Your Personal Information collected by Oculus is stores on Oculus’s servers.

Your Personal Information and Gaming Data collected by us is stored on third-party cloud servers. Although we provide appropriate firewalls and protections, we cannot warrant the security of Personal Information transmitted as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and will take necessary measures to mitigate such events. You are required to be careful to avoid “phishing” scams, where someone may send you an e-mail that looks like it is from us asking for your Personal Information.

You have the right to access your Personal Information in our possession, right to have us rectify or modify any such Personal Information, right to have us erase/delete your Personal Information, right to restrict us from processing such Personal Information, right to object to our use of your Personal Information, withdraw consent at any time where we are relying on consent to process your Personal Information. Depending on the nature of your request, we may ask you to complete a Personal Information request form or seek certain details to verify the request. In certain cases, we may charge a fee for this service, but we will inform you at the time. All requests for Personal Information will be handled within a reasonable period of time. Our Platform may contain links to other websites or applications of your interest. Please note that we do not have any control over such other websites, applications, social media platforms and you will be accessing these websites/applications at your own risk. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such websites, applications, social media platforms and those are not governed by this Privacy Policy. You should exercise caution and look at the privacy policy applicable to such websites, applications, social media platforms including those of social media platforms.

We may send you communications including but not limited to (a) notices about your use of our Platform , including those concerning violations of use, (b) updates, (c) promotional information regarding our Platform, and (d) newsletters. You may opt out of receiving promotional emails and newsletters from us by following the unsubscribe instructions provided in those emails. Residents of the European Union (“EU”) and United Kingdom (“UK”) should note that this Privacy Policy has been updated in accordance with the requirements of the EU General Data Protection Regulation (the “GDPR”) and the UK GDPR, the United Kingdom Data Protection Act 2018, the Privacy and Electronic Communications Regulations, and any regulation superseding any of the foregoing (“UK Privacy Laws”). As per the provisions of the GDPR and UK Privacy Laws we shall be considered the Controllers of the Personal Information collected as a result of your use / access of the Website and Processors of the Personal Information collected as a result of your use / access of the Platform.

  1. CHILDREN’S PRIVACY

We do not knowingly collect or solicit Personal Information from children under the age of thirteen (13) years without the prior, verifiable consent of his or her legal representative. If you are a child under the age of thirteen (13) years, please do not provide any Personal Information. This Privacy Policy shall be construed and governed by the laws of India. You agree that the courts in Pune, India shall have exclusive jurisdiction over such disputes.
